Federal fair housing enforcement is entering a period of significant uncertainty. Recent developments indicate that HUD is pulling back from several traditional fair housing enforcement and oversight roles, including decreased civil rights enforcement capacity, fewer visible federal enforcement actions, less support for local fair housing organizations, reconsideration of disparate-impact standards, withdrawal of affirmative fair housing planning requirements, and a proposed repeal of affirmative fair housing marketing regulations.

For owners, agents, property managers, compliance staff, and affordable housing professionals, this shift presents a dangerous temptation: to assume that less federal enforcement means less compliance risk. That assumption is incorrect.
